Website, Product, Service, Refund, Privacy, and Payment Terms & Conditions

Welcome to Elevator Compliance Solutions LLC (“ECS,” “we,” “us,” or “our”). By accessing or using our website, purchasing products, requesting services, submitting information, or otherwise engaging with ECS, you agree to be bound by the following Terms and Conditions. Please review them carefully. If you do not agree to these Terms, you should not use our website, products, or services.

1. General Terms

1.1 Acceptance of Terms

By purchasing products or services from ECS, submitting an order, requesting inspection or consulting services, accessing our website, or otherwise engaging with ECS, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

1.2 Modifications

ECS reserves the right to update, revise, or modify these Terms and Conditions at any time without prior notice. Any changes will become effective immediately upon posting to our website. Continued use of our website, products, or services after any such changes constitutes acceptance of the revised Terms.

2. Products and Services

2.1 Merchandise

ECS offers industry-specific merchandise and materials, including but not limited to signs, braille, forms, and other products tailored to the elevator and building compliance industry. Custom or special-order items may be subject to additional terms, production timelines, and non-refundable conditions.

2.2 Inspection and Consulting Services

ECS provides professional inspection and consulting services, which may include, but are not limited to, elevator and escalator inspections, maintenance evaluations, traffic analysis, modernization consultations, contract reviews, compliance support, and related professional services.

2.3 Professional and Lawful Use

ECS products and services are intended for professional, lawful, and code-compliant use only. Customers are responsible for ensuring that any products, documents, reports, recommendations, or services obtained from ECS are used in accordance with applicable laws, codes, regulations, industry standards, and authority having jurisdiction requirements.

3. Payment Terms, Fuel Surcharge, Travel, Mobilization, and Late Fees

3.1 Payment Obligations

Customers agree to pay all invoices, fees, charges, and amounts due to ECS in accordance with the payment terms stated on the applicable invoice, proposal, quote, agreement, purchase order, or service authorization.

3.2 Fuel Surcharge

ECS may apply an 8% fuel surcharge to invoices, quotes, service orders, inspections, consulting services, site visits, and other billable services where travel, transportation, scheduling, or field service coordination is required. This surcharge is intended to help offset fuel, vehicle, travel, and related operational costs associated with providing services. The fuel surcharge may be listed as a separate line item or included as part of the total service charge, unless otherwise stated in writing by ECS.

3.3 Travel & Mobilization

ECS may apply travel, mobilization, administrative coordination, or site visit charges for services that require travel to a customer location, jobsite, building, facility, or project site. Travel and mobilization charges may include, but are not limited to, time spent coordinating and preparing for the service, travel time, mileage, parking, tolls, fuel, vehicle-related expenses, scheduling coordination, and other reasonable costs associated with dispatching ECS personnel or representatives to perform the requested services.

Travel and mobilization charges may be billed as a flat fee, percentage-based charge, hourly charge, mileage-based charge, or separate line item, depending on the nature, location, timing, and scope of the requested service. Unless otherwise stated in writing by ECS, travel and mobilization charges are non-refundable once scheduling, coordination, dispatch, or site mobilization has begun.

3.4 Late Payments

Any invoice or balance not paid by the applicable due date shall be considered past due. ECS reserves the right to suspend, delay, or withhold services, reports, documents, deliverables, future scheduling, or account access for accounts with outstanding balances.

3.5 Late Fee / Finance Charge

Past-due balances may be subject to a late fee or finance charge of 1.5% per month, equivalent to 18% per year, or the maximum amount permitted by applicable law, whichever is less. Late fees may accrue monthly on unpaid balances until the outstanding amount is paid in full.

3.6 Collection Costs

In the event ECS must take action to collect any past-due balance, the customer agrees to be responsible for all reasonable costs of collection, including but not limited to administrative costs, collection agency fees, attorneys’ fees, court costs, and any other costs permitted by law.

4. Refund and Return Policy

4.1 Downloadable PDF Products

All sales of downloadable PDF products are final. Due to the nature of digital goods, ECS does not offer refunds, returns, exchanges, or credits for downloadable items purchased through our platform.

4.2 Subscription-Based Services

Refunds for subscription-based services are reviewed on a case-by-case basis. Refund requests must be submitted in writing to support@elevatorcompliancesolutions.com within 7 days of the applicable transaction. Approval of any refund is at the sole discretion of Elevator Compliance Solutions LLC.

4.3 Merchandise Refund Eligibility

Refund requests for eligible merchandise must be submitted within 30 days of receiving the merchandise. To qualify for a refund, items must be returned in their original, unused condition, with all packaging, labels, and materials intact.

Custom, personalized, special-order, or made-to-order items are non-refundable unless the item is defective or incorrect due to ECS’s error.

4.4 Defective or Incorrect Items

Customers must contact ECS within 10 days of receiving a defective or incorrect item. The customer must provide a detailed description of the issue along with supporting photos. If ECS determines that the item is defective or incorrect due to ECS’s error, ECS may arrange for a replacement, refund, or other appropriate resolution, including applicable shipping costs where appropriate.

4.5 Return Shipping

Customers are responsible for return shipping costs unless the return is due to an error by ECS. ECS is not responsible for lost, damaged, or delayed return shipments.

4.6 Refund Timeline

Approved refunds will be processed within 7–10 business days and issued to the original payment method whenever possible. Processing times may vary depending on the customer’s financial institution or payment processor.

5. Privacy Policy

5.1 Information We Collect

ECS may collect personal information such as your name, company name, email address, phone number, billing information, shipping information, payment details, and information submitted when placing an order, registering for services, requesting inspections, or communicating with ECS.

ECS may also collect non-personal information, including but not limited to browser type, IP address, device information, pages visited, website usage data, and other analytics-related information.

5.2 How We Use Your Information

ECS may use collected information to:

  • Process orders and payments;
  • Provide products and services;
  • Schedule, coordinate, and complete inspections or consulting services;
  • Communicate regarding orders, quotes, invoices, reports, updates, and service requests;
  • Improve our website, products, services, customer support, and internal operations;
  • Send promotional, informational, or service-related communications where permitted by law.

5.3 Data Security

ECS implements commercially reasonable and industry-standard security measures designed to protect customer information. However, no method of transmission over the internet or method of electronic storage is completely secure. ECS cannot guarantee absolute security of information transmitted or stored electronically.

5.4 Sharing of Information

ECS does not sell personal information. ECS may share information with third parties only as necessary to process payments, fulfill orders, ship products, provide services, operate our business, comply with legal obligations, enforce our rights, or as otherwise permitted by law.

5.5 Customer Rights

Customers may request access to, correction of, or deletion of personal information by contacting ECS at support@elevatorcompliancesolutions.com. ECS will review and respond to such requests in accordance with applicable law.

6. Limitation of Liability

To the fullest extent permitted by law, ECS shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to the use of, or inability to use, our website, products, services, reports, recommendations, or deliverables.

This limitation includes, but is not limited to, damages for loss of profits, loss of revenue, loss of data, business interruption, delays, operational impacts, compliance-related consequences, or any other commercial or economic loss, whether based in contract, tort, negligence, strict liability, or any other legal theory.

7. Intellectual Property

All content on the ECS website and related materials, including but not limited to text, graphics, logos, designs, images, software, documents, reports, templates, forms, branding, and other materials, are the property of ECS or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.

Unauthorized copying, reproduction, modification, distribution, display, resale, or use of ECS materials is strictly prohibited without prior written authorization from ECS.

8. Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms, ECS products, ECS services, or use of the ECS website shall be resolved in the courts located in Delaware, unless otherwise required by applicable law.
